Section 1: Nature and Scope of the Service
1.1 NeuxScience Cognitive Health (the Service) provides education and research-grade cognitive screening products to members of the public.
1.2 The Service offers research-informed assessments of a range of cognitive constructs and executive functions, including working memory, attention, inhibition, cognitive flexibility, planning, problem-solving, decision-making, processing speed, short-term and long-term memory, cognitive control, and fluid reasoning.
1.3 The Service also includes public educational resources and workshops, such as instructional materials on cognitive neuroscience, blog articles that translate complex research findings into accessible explanations, podcasts exploring cognitive health and executive functions, and workshops designed to support educational engagement and public understanding of cognitive science.
1.4 NeuxScience Cognitive Health is a research-led service focused on understanding and improving human cognitive function across the lifespan through screening products, public educational resources, and workshops.
1.5 The Service is designed for use by three broad age groups: children aged 6 to 17, adults aged 18 to 64, and older adults aged 65 and above.
1.6 The Service is operated by Neux Ltd (the Company, we, us or our), a company incorporated in England and Wales under company number 09021397, with its registered office at 86-90 Paul Street, London, EC2A 4NE, United Kingdom.
Section 2: Acceptance of These Terms
2.1 By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and the Privacy Policy below.
2.2 If you do not agree to these terms, you must not use the Service.
2.3 These terms form a legally binding agreement between you and the Company.
Section 3: Not a Clinical or Medical Service
3.1 The Service is an education and research service. It is not a clinical service, medical device, healthcare provider, or emergency service.
3.2 The Service does not diagnose, treat, monitor, or prevent any disease, disorder, or medical condition, and it does not provide medical advice, psychological advice, or therapeutic advice.
3.3 Any outputs, reports, scores, or recommendations produced by the Service are provided for educational, informational, and research purposes only.
3.4 If you have concerns about memory, attention, cognition, mental health, neurological symptoms, or day-to-day functioning, you should seek advice from a GP, registered psychologist, or other appropriately qualified healthcare professional.
3.5 Your use of the Service does not create a doctor-patient, psychologist-patient, therapist-client, fiduciary, or other clinical relationship with the Company.
Section 4: What the Service Does
4.1 NeuxScience Cognitive Health is a research-led service focused on understanding and improving human cognitive function across the lifespan.
4.2 The Service measures multiple cognitive constructs and executive functions as interacting systems rather than as isolated tasks.
4.3 The NeuxScience® platform uses adaptive machine learning to model aspects of a user’s cognitive profile, provide personalised task pathways, and study possible training and transfer effects.
4.4 The public screener is intended to provide a research-grade baseline snapshot of cognitive performance for educational and self-awareness purposes. It is not a diagnosis.
4.5 After completing the assessment, users may receive a profile that includes performance across cognitive domains, pattern-level observations, age-referenced comparisons, general educational recommendations, and an option to participate in research.
Section 5: User Responsibilities
5.1 You agree to use the Service only for its intended educational and research purposes.
5.2 You must not:

use the Service as a substitute for professional medical, psychological, or therapeutic advice, diagnosis, or treatment;

delay or avoid seeking professional advice because of information obtained through the Service;

rely on the Service for clinical, safeguarding, employment, insurance, or other high-stakes decisions;
-
copy, reverse engineer, decompile, disassemble, or otherwise attempt to extract source code, models, or underlying methods, except where this cannot lawfully be restricted;
-
misuse the Service in a way that could damage, disable, overburden, impair, or compromise it; or
-
attempt to gain unauthorised access to the Service or any connected systems.
5.3 You are responsible for ensuring that information you provide is accurate to the best of your knowledge.
5.4 You are responsible for maintaining the confidentiality of any access credentials, session links, or identifiers used to access the Service.
Section 6: Age Restrictions and Parental Consent
6.1 Children aged 6 to 17 may use the Service only with the involvement or supervision of a parent or legal guardian.
6.2 Where consent is relied on for the processing of a child’s personal data in connection with an online service, parental responsibility holder authorisation is required for children under the age of 13 in the United Kingdom.
6.3 A parent or legal guardian who permits a child to use the Service confirms that they are authorised to act on the child’s behalf and that they have read and accepted these terms where applicable.
6.4 The Company does not knowingly collect personal data from children under the age of 6. If such data is identified, reasonable steps will be taken to delete it.
6.5 Parents and legal guardians may exercise applicable privacy rights on behalf of their child, subject to verification and the child’s own rights under applicable law.
Section 7: Intellectual Property
7.1 All intellectual property rights in the Service, including software, task designs, text, graphics, branding, reports, underlying models, and other content, are owned by or licensed to the Company.
7.2 NeuxScience® is a registered trademark of Neux Ltd. No right is granted to use that mark except as expressly permitted in writing.
7.3 Subject to these terms, the Company grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, educational, and non-commercial use.
7.4 You must not reproduce, distribute, adapt, publish, sell, or commercially exploit any part of the Service without prior written consent, except where permitted by law.
Section 8: Liability
8.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under the law of England and Wales.
8.2 Subject to section 8.1, the Service is provided on an as is and as available basis.
8.3 Subject to section 8.1, the Company does not warrant that the Service will be uninterrupted, error-free, fully secure, always available, or suitable for any particular purpose.
8.4 Subject to section 8.1, the Company will not be liable for any indirect or consequential loss, loss of profits, loss of opportunity, loss of goodwill, or loss of data arising out of or in connection with the use of, or inability to use, the Service.
8.5 If you are using the Service as a consumer, nothing in these terms affects any rights you may have under mandatory consumer protection law, including the Consumer Rights Act 2015.
Section 9: Indemnity
9.1 To the extent permitted by law, you agree to indemnify and keep indemnified the Company, its officers, employees, and contractors against losses, liabilities, costs, and expenses arising out of your breach of these terms, your unlawful use of the Service, or your infringement of any third-party rights.
Section 10: Governing Law and Jurisdiction
10.1 These terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales.
10.2 If you are a consumer resident in the United Kingdom, you may also have the benefit of any mandatory provisions of the law of the part of the UK in which you live. If you are a business user, the courts of England and Wales shall have exclusive jurisdiction.

11.1 The Company may amend these terms from time to time.
11.2 Any updated version will be published on the website with a revised last updated date.
11.3 Where a change is material, reasonable steps will be taken to bring it to users’ attention before or when the change takes effect.
11.4 By continuing to use the Service after updated terms take effect, you agree to the revised terms.
Section 12: Severability and Waiver
12.1 If any provision of these terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be treated as severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12.2 A failure or delay in exercising any right or remedy shall not constitute a waiver of that or any other right or remedy.

13.1 For the purposes of the UK General Data Protection Regulation and the Data Protection Act 2018, Neux Ltd is the data controller for personal data processed in connection with the Service.

Section 14: Personal Data Collected
14.1 The Company applies the principle of data minimisation and seeks to collect only the personal data reasonably necessary for the stated purposes.
14.2 The Service may be used without providing a name or email address where on-screen results are sufficient.
14.3 Depending on how the Service is used, the following categories of personal data may be collected:

cognitive task and performance data;

optional email address where a report is requested by email;

technical and usage data, such as IP address, browser type, device information, operating system, and referral information;

communications, feedback, or support requests sent to the Company.
14.4 The Company does not intentionally collect payment information through the Service where the Service is offered free of charge.
14.5 The Company does not ask users to provide special category health data through a free public screener as a routine requirement. However, cognitive performance data may still constitute personal data and will be handled accordingly.
Section 15: Lawful Bases for Processing
15.1 Personal data is processed only where there is a lawful basis under Article 6 UK GDPR.
15.2 The lawful bases relied on may include:

Consent: 6(1)(a), sending a report by email, non-essential cookies, and other optional activities where consent is requested;

Legitimate interests: 6(1)(f), operating, securing, evaluating, and improving the Service, and carrying out proportionate research activity;

15.3 Where consent is relied on, it may be withdrawn at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
15.4 The Service is not used for direct marketing unless a separate lawful basis and appropriate notice are provided.
Section 16: Purposes of Processing
16.1 Personal data may be processed for the following purposes:

analysing and improving the Service;

Section 17: Anonymised Research Use

17.2 If data is truly anonymised so that no individual is identifiable, it is no longer personal data for the purposes of UK data protection law.
17.3 The Company may retain anonymised data for scientific research, validation, benchmarking, and service improvement for longer periods, including on an indefinite basis where appropriate.
17.4 Where anonymisation is not yet complete and identifiable data is still held, applicable rights under UK data protection law continue to apply.

18.2 Personal data may be shared only where reasonably necessary, including with hosting providers, technology providers, professional advisers, or processors acting on the Company’s instructions and subject to appropriate contractual safeguards.

18.4 Anonymised and aggregated findings may be used in research outputs, reports, academic publications, or presentations, provided no individual is identified.
Section 19: International Transfers
19.1 Personal data should, where possible, be stored and processed within the United Kingdom or countries recognised as providing adequate protection.
19.2 If personal data is transferred outside the United Kingdom, appropriate safeguards will be used in accordance with Chapter V UK GDPR, such as adequacy regulations, the UK International Data Transfer Agreement, or other approved mechanisms.

20.1 Appropriate technical and organisational measures are used to protect personal data, taking into account the nature of the data and the risks involved.

21.3 Where possible, identifiable records are deleted, anonymised, or aggregated when they are no longer needed.
21.4 A report delivery email address should not be kept longer than necessary to send the requested report and deal with follow-up delivery issues.
